Privacy Policy
Hopeful Horizon Counseling LLC
Effective date and last updated: October 2, 2026
Hopeful Horizon Counseling LLC ("Hopeful Horizon Counseling," "we," "us," or "our") is a Utah counseling practice. This Privacy Policy explains how we collect, use, protect, and disclose information through https://hopefulhorizons.com/, website forms, appointment inquiries, and related email and text message communications.
This policy addresses website and communications privacy. It does not replace our separate Notice of Privacy Practices for protected health information, where applicable. Clinical records and information collected for treatment are subject to applicable healthcare privacy requirements. To request the clinical notice, use the contact information below.
1 Information We Collect
We collect information you choose to provide when you contact us, request a consultation or appointment, complete a website form, or subscribe to communications. Depending on your interaction, this may include:
Your first and last name, email address, and telephone number.
Your appointment preferences, contact preferences, and the information you include in an inquiry.
Your SMS consent choices, the date and method of consent, the disclosure you accepted, and opt-out requests.
Communications you send us and records needed to respond to your request.
Our website hosting services may also collect technical information, such as your IP address, browser and device type, pages visited, referring pages, and access times. Information collected through any enabled cookies or analytics tools is described below.
Please avoid sending diagnoses, treatment details, insurance documents, or other sensitive health information through general website forms, ordinary email, or SMS. Contact the practice for the appropriate channel for clinical information.
2 How We Use Information
We use information to respond to inquiries, arrange consultations and appointments, provide administrative support, communicate about scheduling, and maintain records of your communication preferences and consent. We may also use technical information to maintain website functionality, troubleshoot problems, and protect against misuse.
We send text messages only within the scope of your consent. If we offer promotional communications, we obtain any separately required consent. We also use information as necessary to meet applicable legal obligations and respond to privacy or support requests.
3 How We Disclose Information
We may provide necessary information to service providers that help operate our website, manage appointment inquiries, maintain communication records, deliver messages, or provide customer support. These providers are authorized to handle information on our behalf for the services they perform, subject to appropriate confidentiality and security requirements.
We may disclose information when required by applicable law or a valid legal process. Disclosures of protected health information are governed by applicable healthcare privacy requirements. The specific restrictions on mobile information and SMS consent in Section 4 apply to our SMS program and control over any broader description of information sharing in this policy.
4 SMS and Text Messaging Privacy
Hopeful Horizon Counseling LLC SMS Program
With your consent, Hopeful Horizon Counseling LLC may send appointment confirmations and reminders, consultation follow-ups, scheduling updates, and responses to service inquiries. Any promotional text messages require separate marketing consent. Providing a telephone number or submitting an inquiry alone does not enroll you in an SMS program.
Information We Collect for SMS
When you opt in, we collect your mobile telephone number and any name, email address, or other information you voluntarily provide on the opt-in form. We also maintain consent records and relevant messaging records, including delivery information and opt-out requests. This information is used to deliver the messages you agreed to receive, provide support, document consent, and honor your communication preferences.
Mobile Information and Consent Protection
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Support and messaging service providers may process necessary SMS information solely on our behalf to operate the program. They are not authorized to use your mobile information or consent for their own marketing. We do not sell or rent mobile information or SMS opt-in data.
Consent and Your Choices
SMS participation is voluntary. You may decline SMS communications and still request or receive our services. Consent to receive marketing text messages is not a condition of purchase or treatment. When offered through website forms, SMS consent is obtained through a separate, optional checkbox that is not preselected; marketing consent is separate from informational messaging consent.
You must be 18 years of age or older to enroll in this SMS service. By opting in, you confirm that you meet this age requirement. This restriction applies to SMS enrollment and does not determine eligibility for counseling services.
Message Frequency and Rates
Message frequency varies based on your appointments, inquiries, and the communications you request. Message and data rates may apply. Contact your wireless provider with questions about your text or data plan. Carriers are not liable for delayed or undelivered messages.
Opt Out and Support
You may opt out of SMS messages at any time by replying STOP to any message from us. You will receive one final confirmation message and will not receive further SMS messages from us unless you provide new consent. We also honor other reasonable requests to stop texting, including requests made using the contact information below.
For assistance, reply HELP, email contact@hopefulhorizons.com, or call (801) 427-6376. To resume messages after opting out, enroll again through the original opt-in process and provide new consent. Opting out of SMS does not prevent you from contacting the practice or receiving services through other available channels.
SMS is not a secure channel for detailed clinical information and is not monitored as an emergency service. Please use the practice's designated clinical communication channels for sensitive information.
6 Data Security
We use reasonable administrative and technical safeguards designed to protect personal information against unauthorized access, loss, misuse, or disclosure. These include restricting access to authorized personnel who need the information, using HTTPS encryption for website connections, protecting accounts with authentication controls, and limiting information supplied to service providers to what is needed for their work.
No website, electronic storage system, email service, or SMS network can guarantee complete security. Our use of website encryption does not mean ordinary SMS messages are end-to-end encrypted.
7 Data Retention
We retain website inquiries and communication records for as long as reasonably needed to respond to your requests, provide services, maintain appropriate business records, resolve disputes, and meet legal obligations. SMS information is retained while you remain opted in and for a reasonable period afterward to document consent, address support requests, and meet recordkeeping obligations.
After you opt out, we may retain a limited suppression record, such as your mobile number and opt-out status, to prevent further messages without new consent. Clinical records are retained under separate healthcare recordkeeping requirements.
8 Your Privacy Choices and Requests
You may contact us to request access to, correction of, or deletion of personal information associated with website inquiries or communications, subject to applicable law and necessary recordkeeping exceptions. We may verify your identity before acting on a request. Any statutory privacy rights depend on the applicable law and its coverage of our practice.
You can withdraw SMS consent as described above, unsubscribe from promotional emails using the instructions in those emails, or contact us to update your communication preferences. Requests concerning clinical records should be directed to the practice and will be handled under applicable healthcare privacy requirements.
9 Children and Minors
The general website and SMS enrollment process are not directed to children under 13, and we do not knowingly collect their information through those channels. If you believe a child under 13 has submitted information through the general website, contact us so we can address it. Information concerning minors receiving counseling is handled through appropriate clinical processes and applicable consent and privacy requirements.
10 Changes to This Policy
We may update this Privacy Policy when our practices, services, or applicable requirements change. We will post the updated policy with a revised date and provide additional notice when required. An update to this policy does not by itself create or expand your consent to receive text messages.
